2. Description of Service

VitaCal is a nutrition tracking application that allows users to:

• Log meals and track calorie and macro intake
• Use AI-powered photo recognition to identify foods
• Set and monitor nutritional goals
• Track water consumption
• View nutrition history and trends

3. Account Registration

To use certain features of VitaCal, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorised use

4. Subscriptions and Payments

VitaCal offers premium features through subscription plans. By subscribing:

• You agree to pay the subscription fees displayed at the time of purchase
• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage or cancel subscriptions through the App Store or Google Play
• Refunds are handled according to Apple's or Google's refund policies

5. User Conduct

You agree not to:

• Use the app for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Upload malicious content or interfere with the app's operation
• Share your account credentials with others
• Use automated systems to access the app

VitaCal is not a medical device and does not provide medical advice.

• The nutritional information and recommendations provided are for informational purposes only
• AI-generated nutritional estimates may not be 100% accurate
• Always consult a healthcare professional before making significant dietary changes
• Do not use VitaCal as a substitute for professional medical advice, diagnosis, or treatment
• If you have a medical condition or eating disorder, consult your doctor before using this app

7. Intellectual Property

All content, features, and functionality of VitaCal are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. User Content

You retain ownership of content you submit (such as meal photos and food logs). By submitting content, you grant us a non-exclusive license to use, process, and store it for the purpose of providing the service.

9. Third-Party Services

VitaCal integrates with third-party services including:

• Firebase (authentication and data storage)
• Apple and Google sign-in services
• AI processing services for meal recognition

Your use of these services is subject to their respective terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by law:

• VitaCal is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim
• We are not responsible for any health outcomes resulting from use of the app

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the app or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the app settings or by contacting support.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms. We will notify you of significant changes via the app or email.

14. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
